For the First Post, Genuiness of Assent, is a complete agreement amid two competent parties. Any party to contract who elaborates that he or she actually did not unaffectedly assent upon the terms of the contract may void the contract. Usually a genuine assent would lack due to mistake, or may be because of fraudulent misrepresentation, undue influence or duress, the exact elements of a contract. Contract are found to lack genuine assent when it is voidable and not a void contract (McCormick et al., 1998).
